Opmerkingen over gegevensbescherming

Het volgende privacybeleid is van toepassing op de website die beschikbaar is op www.pm-international.com en op de verwerking van uw persoonlijke gegevens als klant of teampartner van PM-International.

De bescherming van uw persoonlijke gegevens en uw privacy zijn belangrijk voor ons.

Daarom leggen we hieronder graag uit wat PM-International doet om u en ons in dit opzicht recht te doen. We leggen u graag uit welke persoonlijke gegevens we verzamelen, hoe we deze gebruiken en hoe we uw gegevens beschermen. U komt ook te weten aan wie we deze gegevens doorgeven en hoe u uw gegevens kunt laten wijzigen. Het gegevensbeschermingsbeleid van PM-International is in overeenstemming met de toepasselijke wettelijke bepalingen van de lokale toepasselijke wetgeving en de bepalingen van de Algemene Verordening Gegevensbescherming van de EU (GDPR (EU) 2016-679). In dit privacybeleid wordt uitgelegd welke gegevens PM-International opslaat en hoe deze worden gebruikt.

Ontvangers of categorieën ontvangers van de persoonsgegevens

Bij de verwerking van uw gegevens werken we samen met de volgende dienstverleners die toegang hebben tot uw gegevens:

• Aanbieder van sociale mediaplatforms
• Advertentienetwerken (voor advertenties)
• Betalings- en verzenddienstaanbieder
• Aanbieder van tools voor webanalyse
• Dienstverlener op het gebied van naleving en online bewaking van industriële eigendomsrechten.

 

Duur waarvoor de persoonlijke gegevens worden opgeslagen:

We slaan uw gegevens op,

• als u toestemming hebt gegeven voor de verwerking, maximaal totdat u uw toestemming intrekt,
• als we de gegevens nodig hebben voor de uitvoering van een contract, maximaal zolang de contractuele relatie met u bestaat of wettelijke bewaartermijnen van toepassing zijn,
• als we de gegevens gebruiken op basis van een gerechtvaardigd belang, maximaal zolang uw belang bij verwijdering of anonimisering niet prevaleert.

 

Gegevensbronnen

We ontvangen de gegevens van u (inclusief over de apparaten die u gebruikt).

 

Gegevensoverdracht naar derde landen

Gegevens worden doorgegeven aan derde landen buiten de Europese Unie. Dit gebeurt op basis van contractuele regels die zijn vastgelegd in de wet, die bedoeld zijn om uw gegevens adequaat te beschermen en die u op verzoek kunt inzien.

 

Recht op toegang, rectificatie of wissing of beperking van de verwerking of het recht om bezwaar te maken tegen de verwerking en het recht op gegevensoverdraagbaarheid:

U hebt het recht,

– om informatie te vragen over de verwerking van uw gegevens,

– om uw gegevens te corrigeren,

– om uw gegevens te laten verwijderen of blokkeren,

– om de verwerking te beperken,

– bezwaar maken tegen de verwerking van uw gegevens,

– om uw gegevens in een overdraagbaar formaat te ontvangen en door te sturen naar een derde partij,

– om uw toestemming voor de verwerking van uw gegevens in de toekomst in te trekken en

– een klacht in te dienen bij de bevoegde toezichthoudende autoriteit over ongeoorloofde gegevensverwerking. De bevoegde toezichthoudende autoriteit is de Autoriteit Persoonsgegevens. Vereiste of verplichting om gegevens te verstrekken

Tenzij uitdrukkelijk vermeld op het moment van verzamelen, is het verstrekken van gegevens niet verplicht.

Gegevensverwerking door derden

Als PM-International in het kader van het verkoopmanagement gegevens doorgeeft aan dienstverleners (zoals pakketdienstverleners, betalingsdienstaanbieders, etc.), sluit PM-International in alle gevallen overeenkomsten voor de afhandeling van bestellingen. Daarom zijn verkooppartners niet alleen wettelijk, maar ook contractueel gebonden aan gegevensbescherming bij PM-International.

Persoonlijke en transactiegerelateerde gegevens worden overgedragen in overeenstemming met de “EU standaard contractuele clausules” gedefinieerd door de EU Commissie.

 

Gegevensbescherming voor bestellingen van goederen, persoonlijke gebruikersprofielen

Bij het bestellen van goederen verzamelt PM-International persoonlijke gegevens van klanten om de bestelling te verwerken en uit te voeren. De volgende klantgegevens worden verzameld, opgeslagen en gebruikt: naam, adres, e-mailadres, geboortedatum, telefoonnummer, betalingsgegevens en, in het geval van betaling via automatische incasso, de gegevens van de rekening en, indien van toepassing, verdere bankgegevens voor creditcardbetalingen. De informatie die u hier verstrekt, wordt uitsluitend gebruikt om uw bestelproces te vereenvoudigen, voor administratieve doeleinden en voor interne analyse. De rechtsgrondslag voor deze verwerking van uw persoonsgegevens is art. 6 para. 1 zin 1 lit. b) GDPR en wordt uitgevoerd om een met u gesloten contract na te komen of voor het uitvoeren van noodzakelijke, precontractuele maatregelen die op uw verzoek worden uitgevoerd.

PM-International gebruikt uw gegevens voor de volgende processen:

• De informatie die is opgeslagen in uw gebruikersprofiel gebruiken om u de mogelijkheden van een aangepaste service en een optimaal gebruik van onze website te bieden.
• Om u individuele aanbiedingen en informatie te sturen die voor u van persoonlijk belang zijn. Uiteraard heeft u ook de mogelijkheid om ons te laten weten dat u dergelijke aanbiedingen en/of informatie niet (meer) wenst te ontvangen. We zullen hier uiteraard gehoor aan geven. Stuur een e-mail naar het e-mailadres van onze DPO dat op de eerste pagina staat.

Voor de levering van de goederen door externe dienstverleners, geeft PM-International de nodige informatie (ontvanger, afleveradres en, indien van toepassing, personen die gemachtigd zijn om de goederen te ontvangen) door aan deze bedrijven en aan leden van de PM-groep van bedrijven om de contractuele verplichtingen na te komen (Art. 6 para. 1 zin 1 lit. b) GDPR (EU) 2016-679). PM-International doet niet aan adresseringsmarketing. PM-International sluit gegevensverwerkingsovereenkomsten met alle externe dienstverleners die voldoen aan de vereisten van Art. 28, 29 GDPR (EU) 2016-679.

U kunt uw toestemming op elk gewenst moment intrekken door te klikken op “hier afmelden” aan het einde van een e-mail met pakketinformatie. Na herroeping zullen wij uw voor dit doel verstrekte gegevens wissen, tenzij u uitdrukkelijk toestemming hebt gegeven voor verder gebruik van uw gegevens of wij ons het recht voorbehouden om gegevens verder te gebruiken, hetgeen wettelijk is toegestaan en waarover wij u in deze verklaring informeren.

De gegevens van de individuele bestellingen blijven toegankelijk in de met een wachtwoord beveiligde gebruikersaccount van deze website voor de desbetreffende klant, met name om vervolgbestellingen van de reeds in het bestelsysteem gekochte producten op eenvoudige wijze mogelijk te maken. De klant kan de inventarisgegevens die zijn opgeslagen voor zijn klantenaccount en het geselecteerde wachtwoord op elk gewenst moment op deze website bekijken en wijzigen in zijn gebruikersaccount – daar in het gedeelte “Mijn gegevens”.

Een klant kan op elk moment zijn klantenaccount en alle bijbehorende gegevens laten verwijderen door een bericht per post, telefoon of e-mail te sturen naar het e-mailadres van onze DPO dat op de eerste pagina staat. In dat geval zal PM-International al uw klantgegevens onmiddellijk verwijderen, tenzij het gebruik ervan nog nodig is voor de afhandeling van een bestelling of PM-International op grond van toepasselijk recht verplicht is deze te bewaren. In beide gevallen worden de gegevens echter zo snel mogelijk geblokkeerd en verwijderd.

 

Speciale versies voor teampartners

In het geval dat u team partner van PM-International bent of wilt worden, verwerken wij de volgende persoonsgegevens voor het aangaan en uitvoeren van een overeenkomst als Team Partner:

Andere gegevens met betrekking tot de activiteit als teampartner:

• distributienummer toegewezen door PM-International
• begindatum van de activiteit als teampartner bij PM-International
• bereikte en daaropvolgende rang volgens de bereikbare carrièreniveaus in het PM-International Marketing Plan
• indien van toepassing, vul een verzendadres in dat afwijkt van het adres
• alle andere verplichte informatie in verband met een activiteit als teampartner
• sponsor
• aanbeveling
• informatie over geplaatste bestellingen
• omzet- en verkoopstatistieken
• Contactgegevens (naam, adres, e-mail) van de klanten in de downline van de teampartner

Als de teampartner een managementfunctie krijgt of als sponsor of manager wil optreden, worden zijn naam en contactgegevens gepubliceerd en doorgegeven binnen het team.

De gegevens van de teampartner worden ook doorgegeven aan het desbetreffende organisatiehoofd (manager), zodat hij of zij de gegevens voor de hele structuur (downline) kan bekijken.

Deze gegevensverwerking is noodzakelijk om het contract als team partner op te stellen en uit te voeren, in het bijzonder om commissiebetalingen te verwerken en de verkoopstructuur te implementeren. De rechtsgrondslag voor de verwerking van deze gegevens is art. 6 para. 1 zin 1 lit. b GDPR.

 

Ontvangers of categorieën ontvangers van de persoonsgegevens:

Bij de verwerking van uw gegevens werken we samen met de hierboven genoemde ontvangers van gegevens (dienstverleners).  Daarnaast geven we uw gegevens ook door aan andere leden van de PM Group voor contractverwerking.

Tenslotte worden uw volgende persoonlijke gegevens doorgegeven aan onze compliance en online IP monitoring service provider, MomentumFactor, 4801 Spicewood Springs Rd, Suite #250, Austin, TX 78759, USA, indien u in de afgelopen 3 maanden als zogenaamde “Business Builder” commissies heeft ontvangen van PM-International of een nieuwe distributeur voor PM-International heeft gesponsord:

• sponsor klantnummer

Het doel van gegevensoverdracht aan MomentumFactor is om eerlijke concurrentie te waarborgen, PM-International te beschermen tegen frauduleuze activiteiten en daarmee de (gezamenlijke) aansprakelijkheid van PM-International te beperken, in het bijzonder in verband met verboden productclaims. Voor deze doeleinden maakt MomentumFactor gebruik van geautomatiseerde procedures om overtredingen door team partners van contractuele afspraken met PM-International en van wettelijke bepalingen op het gebied van mededingingsrecht te identificeren. De rechtsgrondslag voor deze gegevensverwerking is art. 6 para. 1 zin 1 lit. f) GDPR.

De gegevens worden automatisch, in een regelmatige cyclus, gedeeld tussen de PM-International database en MomentumFactor. De diensten van MomentumFactor worden opgeslagen in een Amazon Web Services cloud in de VS. De gegevens worden verwijderd uit onze database in overeenstemming met onze verwijderingsprocedure en vervolgens ook uit MomentumFactor.

De contractuele basis voor de overdracht van persoonsgegevens is het servicecontract en de orderverwerkingsovereenkomst tussen PM-International en MomentumFactor. Daarnaast is de gegevensoverdracht aan Momentum Factor gebaseerd op de relevante EU-standaard contractuele clausules voor de overdracht van persoonsgegevens naar derde landen. MomentumFactor is compliant (officieel gecertificeerd) volgens de GDPR. De infrastructuur, organisatie, product en interne beveiliging van MomentumFactor en de beveiliging en bescherming van gegevens worden extern gecontroleerd en geaudit.

Nieuwsbrief

Als u zich hebt aangemeld voor de PM-International nieuwsbrief, verwerkt PM-International uw persoonlijke gegevens die u aan ons hebt verstrekt om u te informeren over nieuws. U gaat ermee akkoord dat de nieuwsbrief regelmatig naar het opgegeven e-mailadres wordt gestuurd. Voorafgaand hieraan controleren we of de eigenaar van het opgegeven e-mailadres akkoord gaat met het ontvangen van de nieuwsbrief.

PM-International gebruikt een verwerker om de adresgegevens te beheren en de nieuwsbrief te versturen. De serviceprovider heeft alleen toegang tot de persoonlijke gegevens die nodig zijn om de bestelling uit te voeren. De adresgegevens worden niet voor andere doeleinden gebruikt door de dienstverlener of door PM-International zelf. PM-International sluit een overeenkomstige orderverwerkingsovereenkomst met de dienstverlener, die voldoet aan de vereisten van Art. 28, 29 GDPR (EU) 2016-679.

De rechtsgrondslag voor de verwerking van uw persoonlijke gegevens in verband met de verzending van onze nieuwsbrief is art. 6 para. 1 zin 1 lit. a) GDPR in combinatie met uw toestemming.

Als u uw toestemming voor het ontvangen van nieuwsbrieven wilt intrekken, deactiveert u eenvoudig de nieuwsbrieffunctie in uw persoonlijke omgeving als verkooppartner bij e-business. Alle anderen kunnen een e-mail sturen naar het e-mailadres van onze DPO dat op de eerste pagina staat.

 

 

 

Contactformulier

Het contactformulier op onze website is een gemakkelijke manier om snel contact met ons op te nemen. Om het mogelijk te maken contact met ons op te nemen, zijn sommige velden gemarkeerd als verplicht. Als u de velden invult en “Verzenden” selecteert, gaat u ermee akkoord dat uw gegevens samen met het bericht per e-mail naar ons worden verzonden. De gegevens worden niet opgeslagen op de webserver. De gegevens worden 10 jaar door ons bewaard en daarna verwijderd.

De rechtsgrondslag voor de verwerking van uw persoonsgegevens in verband met communicatie via ons contactformulier is art. 6 para. 1 zin 1 lit. a) GDPR in combinatie met uw toestemming.

 

Automatische opslag van toegangsgegevens

Elke keer dat een gebruiker de website van PM-International bezoekt, worden de toegangsgegevens van het proces automatisch opgeslagen in een logbestand. Dit is algemene informatie, zoals de pagina vanwaar het bestand is opgevraagd, de naam van het opgevraagde bestand, de datum en tijd van toegang, de hoeveelheid overgedragen gegevens, het gebruikte protocol en de beschrijvingen die zijn verzonden door de internetbrowser en, indien van toepassing, het besturingssysteem.

Deze algemene informatie wordt geanonimiseerd, d.w.z. dat ze niet wordt opgeslagen samen met persoonlijke gegevens die u eventueel aan PM-International heeft verstrekt en er op geen enkele andere manier mee wordt samengevoegd. Het wordt alleen geanalyseerd voor statistische doeleinden en gebruikt om de inhoud en functionaliteit van de website te verbeteren. Deze gegevens worden niet doorgegeven aan derden voor andere niet-commerciële of commerciële doeleinden. Toegangsgegevens worden maximaal 4 weken in het logbestand opgeslagen.

 

Cookies

Deze website maakt ook gebruik van zogenaamde cookies. Een cookie is een tekstbestand met een identificatienummer dat naar de computer van de gebruiker wordt gestuurd samen met de andere gegevens die daadwerkelijk worden opgevraagd wanneer de website wordt gebruikt en daar wordt opgeslagen. Het bestand wordt daar opgeslagen voor latere toegang en dient om de gebruiker te authenticeren.

Aangezien cookies slechts eenvoudige bestanden zijn en geen uitvoerbare programma’s, vormen ze geen enkel gevaar voor de computer. Cookies bevatten geen persoonlijke gegevens, zodat de bescherming van de privacy is gewaarborgd. Afhankelijk van de instellingen die de gebruiker heeft geselecteerd, accepteert de internetbrowser automatisch cookies. Deze instelling kan echter worden gewijzigd en de opslag van cookies kan worden uitgeschakeld of zodanig worden ingesteld dat de gebruiker wordt gewaarschuwd zodra een cookie wordt ingesteld. Als het gebruik van cookies echter wordt uitgeschakeld, is het mogelijk dat sommige functies van de website niet of slechts beperkt beschikbaar zijn.

Om het gebruikersgedrag op de website van PM-International te bepalen, onderzoeken we hoe u als klant onze website bereikt. Deze informatie wordt verzameld met behulp van cookies (meer informatie vindt u onder webanalyse verderop in de tekst). In dit proces worden echter geen persoonlijke gegevens verzameld (gegevens waaruit uw identiteit kan worden afgeleid). Met deze geanonimiseerde procedure is het niet mogelijk om het betreffende gebruikersgedrag toe te wijzen aan een specifieke persoon.

Sociale netwerken

We gebruiken plugins van verschillende sociale netwerken op onze website.

 

Facebook

Deze website maakt gebruik van de deelknop van het sociale netwerk Facebook.

Facebook wordt beheerd door Meta Platforms, Inc , Willow Road 1601, 94025 Menlo Park, CA, VS en is beschikbaar op www.facebook.de. Deze afzonderlijke sociale plugins zijn te herkennen aan een van de Facebook-logo’s of aan de toevoeging “Facebook Social Plugin”. Een lijst met het uiterlijk en de functies van de afzonderlijke plugins kan hier worden bekeken: developers.facebook.com/docs/plugin. Wanneer u een pagina op onze website bezoekt die een dergelijke sociale plugin bevat, maakt de browser die u gebruikt een directe verbinding met de servers van Meta Platforms, Inc. De inhoud van de sociale plugin wordt door Meta Platforms, Inc rechtstreeks naar uw browser gestuurd, die het in de website integreert. We hebben daarom geen invloed op de omvang van de gegevens die Meta Platforms, Inc verzamelt met behulp van de social plugins en informeren u daarom op basis van ons kennisniveau: door de integratie van de social plugins wordt Meta Platforms, Inc geïnformeerd dat u de betreffende pagina van onze website hebt bezocht, zelfs als u niet als Facebook-gebruiker bent geregistreerd of momenteel niet bij Facebook bent ingelogd. Deze informatie wordt samen met uw IP-adres door uw browser doorgestuurd naar een server van Meta Platforms, Inc in de VS en daar opgeslagen. Volgens de informatie van Meta Platforms, Inc. wordt alleen een geanonimiseerd IP-adres opgeslagen voor niet-geregistreerde gebruikers in Duitsland. Als u bent aangemeld bij Facebook, kan Meta Platforms, Inc uw bezoek aan onze website direct koppelen aan uw Facebook-account. Meta Platforms, Inc ontvangt de informatie over uw bezoek aan onze website, ongeacht of u interactie heeft met de sociale plug-ins of niet. Als u interactie hebt met de sociale plug-ins, bijvoorbeeld door op de “Vind ik leuk”-knop te klikken of door een reactie achter te laten, wordt de betreffende informatie rechtstreeks van uw browser naar Meta Platforms, Inc verzonden en daar opgeslagen. De informatie wordt ook gepubliceerd op Facebook en getoond aan uw Facebook-vrienden. Het doel en de omvang van de gegevensverzameling en de verdere verwerking en het gebruik van de gegevens door Meta Platforms, Inc, evenals uw rechten in dit verband en instellingsopties om uw privacy te beschermen, kunt u vinden in het privacybeleid van Meta Platforms, Inc, dat beschikbaar is op www.facebook.com/about/privacy. Als u een geregistreerde Facebook-gebruiker bent en niet wilt dat Meta Platforms, Inc gegevens over u verzamelt via onze website en deze koppelt aan uw lidmaatschapsgegevens die zijn opgeslagen op Facebook, moet u uitloggen bij Facebook voordat u onze website bezoekt. Het is ook mogelijk om de sociale plugins te blokkeren met add-ons voor uw browser, bijvoorbeeld met de Facebook Blocker, webgraph.com/resources/facebookblocker.

Deze website gebruikt plugins van Youtube.de/Youtube.com, die worden beheerd door Youtube, LLC, 901 Cherry Avenue, San Bruno, CA 94066, VS. Data processing by third parties

If PM-International passes on data to service providers (such as parcel service providers, payment service providers, etc.) in the context of sales management, PM-International concludes order processing contracts in each case. As a result, sales partners are not only bound to data protection by law, but also by contract with PM-International.

Personal and transaction-related data is transferred in accordance with the “EU standard contractual clauses” defined by the EU Commission.

 

Data protection for goods orders, personal user profiles

When ordering goods, PM-International collects personal data from customers in order to process and fulfill the order. The following customer data is collected, stored and used: Name, address, e-mail address, date of birth, telephone number, payment information and, in the case of payment by direct debit, the account details information and, if applicable, further bank details for credit card payments. The information you provide here is used exclusively to simplify your order process, for administrative purposes and for internal analysis. The legal basis for this processing of your personal data is Art. 6 para. 1 sentence 1 lit. b) GDPR and is carried out for the purpose of fulfilling a contract concluded with you or for carrying out necessary, pre-contractual measures that are carried out at your request.

PM-International uses your data for the following processes:

• To use the information stored in your user profile to offer you the possibilities of a customized service and the optimal use of our website.
• To send you individual offers and information that are of personal interest to you. Of course, you also have the option of informing us that you do not wish to receive such offers and/or information or no longer wish to receive them. We will of course comply with this. After revocation, we will delete your data provided for this purpose, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.

The data of the individual orders remain accessible in the password-protected user account of this website for the respective customer, in particular to enable follow-up orders of the products already purchased in the ordering system in a simple manner. The customer can view and change the inventory data stored for his customer account as well as the selected password at any time on this website in his user account – there in the “My data” section.

A customer can have their customer account and all associated data deleted at any time by sending a message by mail, telephone or e-mail to the e-mail address of our DPO figuring on the first page. The purpose of data transmission to MomentumFactor is to ensure fair competition, to protect PM-International from fraudulent activity and thus to limit PM-International’s (joint) liability, in particular in connection with prohibited product claims. For these purposes, MomentumFactor uses automated procedures to identify violations by Team Partners of contractual agreements with PM-International and of statutory provisions in the area of competition law. The legal basis for this data processing is Art. 6 para. 1 sentence 1 lit. f) GDPR.

The data is shared automatically, in a regular cycle, between the PM-International database and MomentumFactor. The services at MomentumFactor are stored in an Amazon Web Services cloud in the USA. The data is deleted from our database in accordance with our deletion procedure and subsequently also from MomentumFactor.

The contractual basis for the transfer of personal data is the service contract and the order processing agreement between PM-International and MomentumFactor. In addition, the data transfer to Momentum Factor is based on the relevant EU standard contractual clauses for the transfer of personal data to third countries. MomentumFactor is compliant (officially certified) according to the GDPR. MomentumFactor’s infrastructure, organization, product and internal security as well as data security and data protection are externally monitored and audited.

Newsletter

If you have subscribed to the PM-International newsletter, PM-International will process your personal data that you have provided to us in order to inform you about news. You agree that the newsletter will be sent regularly to the e-mail address provided. Prior to this, we will check that the owner of the e-mail address provided agrees to receive the newsletter.

PM-International uses a processor to manage the address data and to send the newsletter. The service provider only has access to the personal information required to fulfill the order. The address data will not be used for other purposes by the service provider or by PM-International itself. PM-International concludes a corresponding order processing contract with the service provider, which complies with the requirements of Art. 28, 29 GDPR (EU) 2016-679.

The legal basis for the processing of your personal data in connection with the transmission of our newsletter is Art. 6 para. 1 sentence 1 lit. a) GDPR in conjunction with your consent.

Automatic storage of access data

Every time a user accesses the PM-International website, the access data of the process is automatically stored in a log file. This is general information, such as the page from which the file was requested, the name of the retrieved file, the date and time of access, the amount of data transferred, the protocol used and the descriptions sent by the Internet browser and, if applicable, the operating system.

This general information is anonymized, i.e. it is not stored together with any personal data you may have provided to PM-International and is not merged with it in any other way. It is only analyzed for statistical purposes and used to improve the content and functionality of the website. This data is not passed on to third parties for other non-commercial or commercial purposes. Access data is stored in the log file for a maximum of 4 weeks.
